Welcome to Pitlane Auto Spa. These Terms and Conditions (the "Terms") form a binding agreement between you and Pitlane Auto Spa ("Pitlane Auto Spa," "we," "us," or "our") and govern your visits to and use of our website (https://pitlaneautospa.com/), your enrollment in and use of any unlimited wash membership (a "Membership"), and your purchase and use of our in-person services, including car washes, hand washes, interior cleaning, and oil change services (together, the "Services").

PLEASE READ THESE TERMS CLOSELY. They include an agreement to resolve disputes through individual binding arbitration, a waiver of your right to participate in a class action or jury trial, limits on our liability, and your authorization for recurring automatic charges if you enroll in a Membership.

1. Eligibility

You must be at least eighteen (18) years old and able to form a binding contract to enroll in a Membership or make any payment on the Site. By enrolling, you represent that you own or are authorized to enroll each vehicle you register.

2. Changes to These Terms and to Our Services

We may revise these Terms at any time. We will post the revised version on the Site and update the "Last Updated" date. Your continued use of the Site or the Services after a revision takes effect means you accept the revised Terms.

3. Limited License to Use the Site

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial purposes.

4. Acceptable Use

When using the Site, you agree not to send unsolicited advertising, use bots or scrapers, interfere with the Site’s security, upload malicious code, or use the Services in violation of any applicable federal, state, or local law. At our physical locations, you additionally agree to follow posted signage, staff instructions, and speed/clearance limits.

5. Pitlane Wash Club Memberships

• Enrolling: Membership begins immediately upon enrollment and payment authorization. There is no signup fee.


• Plan Tiers: Memberships are offered in different tiers (e.g., Basic, Silver, Platinum, Flex). Features and pricing vary by location.


• Wash Frequency: Each registered vehicle may receive one (1) wash per twenty-four (24) hour period. "Unlimited" refers to unlimited washes within this daily limit for the duration of your paid billing month.


• Vehicle-Specific: A Membership is tied to a specific registered vehicle, not to a person. It may not be used on any vehicle other than the one registered.


• Multi-Location Access: Your Membership is valid at all participating Pitlane Auto Spa locations.

6. Billing and Automatic Renewal

BY ENROLLING IN A MEMBERSHIP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• You authorize us and our payment processor to charge your payment method on a recurring monthly basis until you cancel.


• Your Membership renews automatically each month and continues indefinitely until cancelled by you or terminated by us.


• You will be billed on the same calendar day each month as the date you enrolled.

7. Cancellation, Pausing, and Refunds

You may cancel your Membership at any time. There are no long-term contracts or cancellation fees. To cancel, contact info@pitlaneautospa.com, call/text +1 (917) 582-5495, or visit our location. To ensure your cancellation is processed before your next charge, please submit it at least two (2) business days before your next billing date. Membership fees are non-refundable, except where required by law.

8. Wash Services – Vehicle Condition and Your Responsibilities

Before entering the wash, you are responsible for confirming your vehicle is in suitable condition. You agree that you will not enter the wash with a vehicle that has loose trim, pre-existing paint damage, cracked glass, damaged seals, open windows, or any mechanical condition making it unsafe to travel through the tunnel. You remain in your vehicle during the wash and agree to follow all attendant instructions.

9. Oil Change Services

Oil change service is available at select locations. A standard oil change includes draining used motor oil, replacing the oil filter, and refilling with the correct grade and quantity of oil. Additional service recommendations are informational only; we do not diagnose or assume responsibility for the overall mechanical condition of your vehicle.

10. Damage Claims Procedure

If you believe your vehicle was damaged while receiving a Service, you must: (1) Report it before leaving the property by notifying an attendant or manager immediately; (2) Allow inspection and documentation; and (3) Submit any follow-up claim in writing to info@pitlaneautospa.com within five (5) calendar days of the visit. Claims not reported before leaving the property may be denied.

11. Disclaimer of Warranties

THE SITE, ITS CONTENT, AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PITLANE AUTO SPA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PITLANE AUTO SPA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SITE, A MEMBERSHIP, OR ANY SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pitlane Auto Spa and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your misuse of the Services.

14. Intellectual Property

The Site and its contents, including the Pitlane Auto Spa name and logo, are owned by or licensed to Pitlane Auto Spa and are protected by copyright and trademark laws.

15. Dispute Resolution – Arbitration and Class Action Waiver

ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA), INSTEAD OF IN COURT. YOU AND PITLANE AUTO SPA WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

16. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Subject to the arbitration section, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Queens County, New York.
